Terms of Service
1. General Provisions
- These Terms of Service govern the provision of electronic services by Studio Kreatywne Mateusz Pawluk, Leśna 12, Mosty, 84-110 Lębork, Poland, Tax ID (NIP): 8393015674, email: kontakt@pawlukstudio.pl, through the Pinly platform available at pinly.pl (hereinafter referred to as the "Platform").
- The User is any person using the Platform, both for browsing and actively using the features available on the Platform.
- Use of the Platform constitutes acceptance of these Terms of Service.
2. Definitions
- Service Provider – Studio Kreatywne Mateusz Pawluk, Leśna 12, Mosty, 84-110 Lębork, Poland, Tax ID: 8393015674, kontakt@pawlukstudio.pl.
- Platform – Pinly web application available at pinly.pl for collecting and managing visual feedback.
- User – natural person, legal entity, or organizational unit without legal personality using the Platform.
- Account – individual User account created after registration on the Platform.
- Project – collection of feedback regarding a specific website or application.
- Feedback – comment or visual note added by the User or third party via a shared link.
3. Services Scope
- The Platform enables:
- User Account registration and management
- Creating projects and generating unique links for collecting feedback
- Collecting visual comments (pins) directly on website preview
- Managing collected feedback (viewing, status marking, deletion)
- Recording user sessions visiting the page (optional)
- Exporting feedback to popular design tools
- Services are provided in a freemium model:
- Free plan – limited number of projects and feedback
- Pro plan – extended access, more projects, session recording, advanced features
- The Service Provider reserves the right to change the scope of functionalities available in individual plans with a 14-day notice period for active paid subscriptions.
4. Account Registration and Management
- A condition for using the full functionality of the Platform is creating an Account by completing the registration form or logging in using external services (e.g., Google, GitHub).
- The User is obliged to provide true data in the registration process.
- The User bears full responsibility for the security of login credentials and password for their Account.
- The User is obliged to immediately notify the Service Provider of any case of Account security breach or unauthorized access.
- The Service Provider has the right to block or delete an Account in case of:
- Violation of these Terms of Service
- Violation of applicable laws
- Using the Platform in a manner harmful to other Users or technical infrastructure
5. Platform Usage Rules
- The User undertakes to use the Platform in accordance with law, good practices, social norms, and the provisions of these Terms.
- It is prohibited to:
- Post content that is unlawful, offensive, pornographic, or violates third-party rights
- Use the Platform to distribute spam, malicious software, or conduct unlawful activities
- Attempt to break in, hack, or interfere with the Platform's technical infrastructure
- Copy, modify, or distribute Platform content and software without Service Provider's consent
- The User bears full responsibility for content posted on the Platform and all consequences of its publication.
- The Service Provider has the right to moderate content and remove feedback violating the Terms without prior notice.
6. Payments and Subscriptions
- Access to the Pro plan requires purchasing an appropriate subscription according to the price list available on the Platform.
- Payments are processed through an external payment operator (Stripe). The Service Provider does not store credit card data.
- Subscription is automatically renewed on a monthly or annual basis, according to User's choice.
- The User can cancel the subscription at any time from Account settings. Cancellation is effective at the end of the current billing period.
- In case of subscription cancellation, the User retains access to Pro plan features until the end of the paid period.
- The Service Provider does not refund unused portion of the fee in case of early subscription termination, unless required by law.
7. Right of Withdrawal (Consumers)
- A consumer who has entered into a distance contract has the right to withdraw from it without giving a reason within 14 days from the date of its conclusion.
- To meet the deadline, it is sufficient to send a statement of withdrawal before its expiry to: kontakt@pawlukstudio.pl.
- The right of withdrawal does not apply if the User has consented to the commencement of service provision before the expiry of the 14-day period and has been informed of the loss of the right of withdrawal.
- In case of effective withdrawal, the Service Provider refunds all payments received immediately, no later than 14 days from receipt of the withdrawal statement.
8. Liability
- The Service Provider makes every effort to ensure the Platform operates continuously and without failures, but does not guarantee uninterrupted access to services.
- The Service Provider is not liable for:
- Content posted by Users
- Damages resulting from improper use of the Platform
- Interruptions in Platform operation caused by force majeure, hacker attacks, problems with external service providers
- Data loss caused by Account deletion by User or Terms violation
- The Service Provider recommends regularly creating backups of content placed on the Platform.
- Service Provider's liability towards businesses is limited to actual damage and does not include lost profits.
9. Complaints
- Complaints regarding Platform operation can be submitted to email: kontakt@pawlukstudio.pl.
- The complaint should include:
- User's name, surname, and email address
- Description of the problem and circumstances of its occurrence
- Expected way of resolving the problem
- The Service Provider considers complaints within 14 business days from receipt. Response is sent to the email address provided in the complaint.
10. Personal Data Protection
- The data controller for User personal data is Studio Kreatywne Mateusz Pawluk, Leśna 12, Mosty, 84-110 Lębork, Poland, Tax ID: 8393015674, kontakt@pawlukstudio.pl.
- Detailed rules for personal data processing, including information about User rights, are set out in the Privacy Policy.
- The Service Provider processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
11. Copyright and Intellectual Property
- All rights to the Platform, including copyrights, trademark rights, name, interface, source code belong to the Service Provider.
- The User obtains a non-exclusive, non-transferable license to use the Platform solely for personal or business purposes in accordance with these Terms.
- The User retains full copyright to content (feedback, projects) created using the Platform.
- Use of the Platform beyond the scope of the license specified in the Terms may result in civil and criminal liability.
12. Changes to Terms
- The Service Provider reserves the right to introduce changes to the Terms for important reasons (e.g., changes in law, expansion or limitation of functionality).
- Users will be informed of changes to the Terms at least 14 days before the changes take effect through a notice on the Platform or by email.
- A User who does not accept the new version of the Terms has the right to terminate the agreement and delete their Account before the changes take effect.
- Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
13. Final Provisions
- For matters not regulated by the Terms, Polish law applies, in particular EU regulations including GDPR.
- Disputes arising from the use of the Platform will be resolved by the competent court according to jurisdiction rules.
- If any provision of the Terms is deemed invalid or ineffective, the remaining provisions remain in force.
- These Terms come into force on November 20, 2025.
